1. Introduction

2. Copyright Infringement Notification

f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
4. Counter-Notification Procedure
If you believe your content was wrongly removed due to a mistake or misidentification, you may send us a counter-notification containing:
a) Your physical or electronic signature.
b) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
d) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Playtiv.com may be found, and that you will accept service of process from the person who provided notification under DMCA 512 subsection (c)(1)(c) or an agent of such person.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we will terminate, in appropriate circumstances, users who are repeat infringers of intellectual property rights. We reserve the right to terminate accounts for even a single instance of infringement in appropriate circumstances.
6. Modifications
We may revise this DMCA Policy at any time. The “Last Updated” date at the top of this page indicates when this policy was last revised. Your continued use of Playtiv.com after any changes constitutes your acceptance of the new terms.
